FOREX CANADA’S PRIVACY AND COOKIE POLICY

At Forex Canada ( “ Forex Canada ” , “ we ” , “ us ” ) the personal data about our customers and visitors to our website are processed (“ you ”). We endeavor to treat your personal data carefully, to keep it safe and to comply with data protection rights.

Forex Canada is a company that deals with performance marketing and lead generation on the Internet. Our small office is in Toronto and we aim to have subsidiaries across all states in Canada.

Information about this policy

The purpose of this policy is to explain when, why and how we process information relating to you ( ” Personal Data ” ). It also contains important information about your legal rights. This policy is not intended to override any terms of any contract you have entered into with us or any rights you may have under data protection laws.

1.  Who is responsible for maintaining your personal data?

Forex Canada Ltd, based at 809 Manning Ave, Toronto, ON M6J 2K6, Canada, is primarily responsible for your personal data (your data controller). Data controller means the company that determines the means and purposes of processing personal data.

You should be aware that although we are generally responsible for maintaining your personal data, information can be stored in databases that other companies have access to. When accessing your personal data, all companies adhere to the standards set out in this policy.

2.  Which personal data do we process?

We can process the following personal data about you:

  • Surname
  • Date of birth
  • E-mail address
  • password
  • IP address
  • Location data
  • Website usage
  • gender
  • Age
  • job
  • Personal preferences and opinions

3.  What do we use your personal data for and when do we process it?

Forex Canada collects information directly from you when you use our services or visit our websites.

We use your personal data to:

  • Send promotional emails about products and services. See also section 6 below on direct marketing.
  •  To analyze information in our systems and databases in order to improve the way in which we conduct our business and operate our websites based on the preferences of the users in order to offer a better service and a better user experience.
  • To improve and target advertising that you receive from us.
  • To register you for a chat forum or a community, insofar as we make it available, in which you can make comments.
  • to fulfill or exercise our legal obligations or rights.

We will only process your personal data for the purposes stated in this section 3 and only if we are convinced that:

  • You have given us your consent to use the data in this way, or
  • our use of your personal data is necessary to support the ‘legitimate interests’ we have as a company (e.g. to improve our products or to carry out analyzes on our data sets) in a way that is proportionate to yours Respects privacy.

4.  Who do we share your personal data with?

We work with numerous third parties who help us manage our business and provide our services. These third parties may need access to your personal data from time to time:

  • Our analytics service providers (such as Google, Hotjar and VWO) who process personal data for their own purposes as data controllers. Please refer to our Cookie Policy in the appendix below to find out how you can prevent analytics providers from accessing your personal data.
  • Service providers or data processors who process your personal data based on our instructions, e.g. B. Cloud services.
  •  When we are required to disclose to comply with a legal obligation or to protect our interests or safety.
  • When we sell, buy or restructure companies or assets, or when our assets are acquired by a third party, including a potential seller or buyer.

5. International transfers of data

International data transfers mean that personal data is transferred to a country outside the European Union.

As set out in Section 4 above, we can give third parties who are located outside the European Union access to your personal data.

We can also pass on your personal data if we receive a legal or regulatory requirement from a foreign law enforcement agency outside the European Union.

We will always take steps to ensure that international data transfers are carried out in a way that protects your rights and interests. Requests for information that we receive from law enforcement or regulatory agencies are carefully checked before personal data is disclosed.

You have the right to request further information from us about the security measures mentioned above. Contact us (see section 8) if you would like further information.

6. Direct Marketing

We use your personal data to send you direct marketing communications about products and services that we and our partners offer in relation to, for example, forex trading, online trading and financial services. This can take the form of email or targeted online advertising.

In some cases, your personal data is processed on the basis of our legitimate interests (see section 3 above). As far as provided by law, this is based on your consent.

You always have the right to decline further direct marketing. You can use the opt-out link found in all direct marketing communications or by contacting us (see section 8).

We take steps to limit direct marketing to a reasonable and proportionate level and to send you communications that we believe may be of interest or relevance to you based on the information we have about you.

7.  How long do we keep your personal data?

We will keep your personal data for as long as is reasonably necessary based on the purposes set out in Section 3 of this Policy.

We may keep your personal data for a certain period of time, for example to meet legal, tax or accounting requirements.

We have a data retention policy for data entrusted to us. If your personal data is no longer required, we will ensure that it is securely resolved or anonymized.

8.  What are your rights?

You have various rights with regard to your personal data. For more information on each of these rights, see the table below.

Please note the following if you want to exercise your rights:

  • to confirm whether we are processing your personal data,
  • To give you a copy of this data,
  • To give you more information about your personal data, e.g. B. what data we have, what we use it for, with whom we pass it on, whether we transfer it to countries outside the EU and how we protect it, how long we keep it, what rights you have, how you can file a complaint where we received your data from and whether we have carried out automated decision-making or profiling, unless this information has already been provided to you in this policy.
Rectification You can ask us to correct incorrect personal data.Possibly. we check the accuracy of the data before we make a correction.
deletion You can ask us to delete your personal data, but only:

  • if they are no longer required for the purposes for which they were collected, or
  • if you have withdrawn your consent (if the processing was based on consent) or
  • after successfully exercising the right to object (see ‘Objection’ below) or
  • they have been processed unlawfully or
  • to comply with a legal obligation.

We are not obliged to comply with your request for deletion of your personal data if the processing of your personal data is necessary to:

  • to comply with a legal obligation or
  • to assert, exercise or defend legal claims.

There are certain other circumstances under which we are not required to comply with your request for deletion, although these are the two most likely circumstances under which we would refuse to do so.

Restriction You can ask us to restrict (i.e. keep, but not use) your personal data, but only if:

  • the accuracy of which is contested (see correction) so that we can check its accuracy, or
  • the processing is unlawful, but you do not want the data to be deleted, or
  • the personal data is no longer required for the purposes for which it was collected, but we still have to assert, exercise or defend legal claims, or
  • You have exercised your right of objection and the examination of the overriding reasons has not yet been completed.

We can continue to use your personal data after a request for restriction:

  • if we have your consent or
  • to assert, exercise or defend legal claims, or
  • to protect the rights of another natural or legal person.
Transferability You can ask us to provide you with your personal data in a structured, commonly used and machine-readable format or to have your personal data transmitted directly to another data controller, but only if:

  • the processing is based on your consent or on the performance of a contract concluded with you and
  • the processing is carried out by automatic means.
Contradiction You can object to the processing of your personal data, which is based on the legal basis of our ‘legitimate interests’, if you are of the opinion that your fundamental rights and freedoms outweigh our legitimate interests.We have the opportunity to prove that we have compelling legitimate interests that take precedence over your rights and freedoms.
International data transfers You can ask us for a copy or a reference to the security measures under which your personal data is transferred to countries outside the European Economic Area.We may redact data transfer agreements or related documents for reasons of business sensitivity (ie obscure certain information contained in these documents).
Supervisory authority You have the right to complain to the responsible local supervisory authority about our processing of your personal data.We ask you to try first to solve problems with us first, although you are always entitled to contact your supervisory authority.

Use of cookies for web analytics and range measurement
